The man who recorded the viral video of the police chokehold death of Eric Garner believes the police have him targeted.

He plans to plead guilty to weapons and drug charges, and faces up to four years behind bars, The New York Daily News reports.

“I’m supposed to be copping out,” Ramsey Orta told The Daily News. “I’m pretty much tired of fighting.”

The newspaper spoke with Orta, 24, on Wednesday in Manhattan Criminal Court. Orta stated that he would plead guilty to the 2014 charges on Thursday.

According to The Daily News, the police have arrested Orta, a member of the organization Copwatch, several times since he shot the Garner video. The prosecutor recently dropped domestic violence charges against him.

Orta told the newspaper that he’s preparing himself for what he has to deal with in state prison. He claimed that someone put rat poison in his food during a stint at Rikers Island Prison Complex in New York City.

“I’m not going to eat the food that’s being provided,” he said. Instead, Orta hopes to “raise enough money” to purchase packaged commissary food while he’s doing time upstate.
